Experience

Breanne has been practicing in the area of litigation for over ten years, handling a broad range of commercial and insurance mandates.  Her commercial practice is focused on fraud and asset tracing.   She assists her clients in fraud recovery by obtaining Anton Piller orders, Mareva Injunctions and Attachment Orders, Norwich Pharmacal orders and preservation orders.   In her insurance practice, Breanne has extensive experience in construction litigation, acting on behalf of developers, general contractors and subcontractors in claims arising from commercial, industrial and residential projects in Alberta. 

Breanne has successfully represented clients before the Provincial Court of Alberta, Court of King’s Bench, Court of Appeal of Alberta, and the Ontario Court of Appeal.

Before joining BD&P, Breanne was an associate at a large international law firm and a partner at a local Calgary firm.

 

Recent Cases

Counsel to the respondent, Kevin Baumann, in an appeal by the Catalyst Capital Group Inc. whose claim was dismissed as being a Strategic Lawsuit Against Public Participation.  The Catalyst Capital Group Inc.  v. West Face Capital Inc., 2023 ONCA 533, leave to appeal to the Supreme Court of Canada denied.

Counsel to the defendants Pekisko Ranch Ltd. and Kevin Baumann in successful response to an application for a redemption order made by Callidus Capital Corporation.  Successfully argued for the dismissal of Callidus’ appeal to the Justice of the Court of King’s Bench.

Counsel to Ingersoll Rand Company in response to application by Yara-Belle Plaine Inc. to strike portions of an affidavit filed in support of summary judgment motion.  Yara Belle Plaine Inc. v Ingersoll-Rand Company, 2019 SKQB 90
